If this package was aimed at qualified installers I would agree but they did not spend all that money for 3 color illustrated box to impress an electrician. These are sold to homeowners in big box stores. I bet far more than half are never inspected. As I said, five of the six labeled applications are outside uses. The fix for intermatic is easy. They just need to add "inside use only" to the spec label on top of the box. The label art could stay the same. Let's see what they say. I did send them a note.

You are the AHJ,Correct? in your opinion,and the fact that you have a model number for the NEMA 3 unit,What more do you need?
What is the model # installed? Make a call. I understand your trying to be fair..That's commendable....But....
Many devices can be used to control many things.Where the controlers are located is the issue.

Actually I am not the AHJ, just offering a non-binding opinion.
My issue is only that we are trying to enforce a listing and labeling violation and the product is actually labeled in a misleading way.
This is how inspectors get a bad name for "making up rules". Do you carry that catalog? I don't and until I got on the internet and looked it up I couldn't come up with the 3R model number or even any proof that this wasn't 3R. I have certainly seen a lot of listed junk that didn't look like it should be what it was listed for. This thing is definitely as "rain tight" as your typical "in use" cover.

Lets see what Intermatic has to say. I should hear from them tomorrow.
