As you know, we are stuck in the ( 1999 ) NEC codes here in LI-NY, with The NYS elect. code
book to follow first, then the NEC. My Question: Air Tight High Hats ( Lumiares ) - The orange sticker inside. Some inspectors approve of the HH-Fixtures as an approved assembly, with the correct Trims, to make it Air tight. Then some inspector don't approve fixtures with the Trims, that are required for air tight application. What they view is: Air Tight - is a fixture approved to be air tight WITHOUT any trim required. What is correct ?
Fixture w/ Trim or Fixture only ??

Whatever the manufacturer says makes it an "Air tight" fixture should be all that matters.

FWIW, i vote for the fixture being air tight without the trim. After all, the fixture won't be leaking air, it will be the 1/8" gap between the drywall & fixture.

The inspector is not looking for the gap of the fixture to the sheetrock, what some inspectors want is a fixture rated " Air Tight " Based on the CAN Only, Some inspectors approve the CAN with the TRIM added to comply to AIR TIGHT Rating. But is some axcept one and not the other, who has the final say, Don't forget under NYS LAW, this issue dose NOT Fall Under AHJ. This is a Building Energy code issue, Not
electrical. Some Towns let the building inspector call the shots...

I believe The NYS Residenial Code requires the housing to be air tight without the trims. I am located on eastern LI and we have to use air tight cans. The town inspectors enforce it.

I have been using " Air Tight Cans " long befor NYS made the code LAW. My problem is that there are two diffrent types of cans by " HALO " One Can is rated " AT " by it's self, NO Trims. The Other Can Requires Trims to make the Rating Of " AT " - I would say, fom the info provided, all Inspectors approve both types of cans installed, but a few inspectors only want the " AT " / NON Trim Can Only. MY FINAL QUESTION: WHO HAS FINAL ANSWER TO THIS, NYS Claims this is a building code issue, not electrical, thus inspectors can not inforce building codes. If the fixture is wired correctly, that is all. I keep getting diffrent answers to this..
