I'm wiring a pub and they want me to install CAT 5 cables for POS (Point of service) terminals. Does the code require me to install them in conduit since this is a large (12,000 sq. ft) commercial building?

NO, however you may be required to sleeve the cable, with EMT, throught any fire walls.

Ran into this one regarding "OPEN Cables"

The Electrical Code: No Problem, unless a special classified area such as Explosion Proof and like ProCircuit stated Fire Seperations...
However, the building code (local building Inspector) caught us with Flame Spread of cables, he wanted FT6 rated cables installed or in conduit, as where the cables were run was classified as a "Return Air Plenum for the HVAC (we were running in "T-bar Ceiling).
