B~ the AHJ has had 4 yrs to act on this.

C~ is (A) prerequiste for (B)?

I don't know how long the problem has existed, but from the look of this and other installations they weren't to code from the beginning!

This and many others were all along the city sidewalk.

I don't know about other states but in NJ once a building/structure has a certificate of occupency (CO), then the AHJ does not have any right to go back into that building. The responsability of maintaining safety falls on the shoulders of the Fire Prevention people. They have the right to go back into any building after the CO has been issued. I believe they don't have much authority with single familt dwellings, but other than that, they have the most power. (I believe.)
