Hi,
Is there ANY requirement in the NEC that requires a switch or disconnect to be Service Entrance rated?

How about when it is used for SERVICE EQUIPMENT? I have always used a service equipment rated disconnect or enclosed breaker as the first throw on a service. Most discos that are not service equipment rated have no means of grounding the neutral.

Try discussing this question with the utility company. I was unable to find the name of the local electrical inspector.

you might consider the requiremnt in 225 regarding the marking of equipment, in addition to those references previously mentioned

225.36 Suitable for Service Equipment.
The disconnecting means specified in 225.31 shall be suitable for use as service equipment.

225.31 Disconnecting Means.
Means shall be provided for disconnecting all ungrounded conductors that supply or pass through the building or structure.
225.36 Suitable for Service Equipment.
The disconnecting means specified in 225.31 shall be suitable for use as service equipment.
Exception: For garages and outbuildings on residential property, a snap switch or a set of 3-way or 4-way snap switches shall be permitted as the disconnecting means.

I would think that about covers it.

Yes that would cover it. Why are inspectors so adamate about getting the SE rating of a disco sold to the public?

IS there a big counterfit market? Don't manufacturers have to meet this when they design these devices?

The inspector I am dealing with sent a comment letter asking to verify compliance with 110.9 and 110.10.
