So, this installation is fine as installed but as soon as the rock is placed it violates 386.10.4 and 386.12.5?

Are you allowed to bend that flat track raceway, or do you have to use a fitting?

That "flat track raceway" is called Wirewmold; and yes, you are allowed to bend it:

OR...
you could carefully use a 1/2" EMT bender - BUT, as EMT is round and wiremold is square your results may vary and the wiremold will more than likely show the tell-tale marks of an EMT bender having been used.
