they met all the conditions to recieve unemployment for being laid off the company just didnt pay into unemployment fund like they were suppossed to.

Do you get paid on a 1099 (contractor) or a W-2 (employee)?
When we had people working for us (Fl) that seemed to be the tax man's test. We guessed wrong on some and paid something like double of what we owed plus an administrative fee, as a first time offender. It was really going to be expensive if we did it again.
