It depends on the NEC edition your jurisdiction is using and your local ammendments.

If you are using the '99: yes, the '02: no.

Locally I can not use romex in commercial at all!

Yeah, 99 I guess, but limited to the 3 story rule.

Yeah, the '99, you got it. Where I live, it is very common to see NM used in many different types of commercial occupancies: hotels, office buildings, grocery stores, nursing homes, donut shops, restaurants ... etc.

I guess it is all a matter of perspective. Cable wiring methods are extremely popular here, and have widespread acceptance.
