I want to tap off an existing welder outlet,that is not used and feed a 20 a 2p breaker that will feed an A/C unit. Is it legal? The breaker will be in a small QO panel.

If the conductors are sized properly and you use some type of switch/disco that will allow only one to be on at the same time, it is OK.
