Is the disconnecting means required by 680.12 of the 2002 or 2005 NEC allowed to be closer than 5ft horizontally from the inside wall of a Hot Tub?

For this question, lets say the disconnecting means is a non fused 60amp pull out type that is typically used for outdoor air conditioning condensors.
