Have the Home Depot "ulektrishon" look at the data/com wiring in his store.
Then, he should either digress, or report the (not a) violation he finds to the local Code Enforcement Officials.
You answered the Q yourself in the last part of your 1st post. Unless there's a specific reason (plenum ceiling, etc) to use p-rated cable, it's not required, commercial or not.
No more than you'd need sealtite in a dry location.
