Algoods Inc. Fined $85,000 for Health and Safety Violation TORONTO, July 5 /CNW/ - Algoods Inc., operating as Tower Automotive, a manufacturer of aluminium heat shields for the auto industry, was fined $85,000 today for a violation of the Occupational Health and Safety Act that resulted in the amputation of five fingers from the left hand of a worker.
On July 7, 2003, a worker was operating a Johnson press (used to mould metal parts) at Algoods Inc.'s plant on Sterling Road in Toronto. A safety device being used by the worker which should have pulled the worker's hand out of the press area during a cycle failed to work properly. The worker's left hand became caught in the press resulting in five fingers on the left hand being amputated.
A Ministry of Labour investigation determined that the safety device had not been properly inspected and failed due to excessive wear and tear.
Algoods Inc. pleaded guilty to failing as an employer to ensure equipment, materials and protective devices provided by the employer were maintained in good condition. This was contrary to section 25(1)(b) of the Occupational Health and Safety Act.
The fine of $85,000 was imposed by Justice of the Peace Gary Miller of the Ontario Court of Justice at Old City Hall in Toronto. In addition, a 25 per cent victim fine surcharge was added, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
