How deep need EMT be under a cememt walk? Or, can the walk itself act as 'running boards' to protect it?

Also- does the extensive rusting of the EMT where the elbow enters the ground perhaps suggest that EMT might not be appropriate at all?

There was no grout- to expose the pipe, I simply needed to use a broom. Nor was the walk completely cut- it appears that someone simply put an abrasive blade in a circular saw, and made several passes, as deep as the saw would go.
